A teenage boy cannot inherit his mother's tenancy, the High Court ruled, due to a housing charity's policy against renting to minors.
After his mother’s sudden death in 2023, Clúid Housing Association decided to terminate the tenancy. The boy, represented by his aunt, challenged this decision, arguing it violated his rights.
However, the court found that the Residential Tenancies Act does not allow those under 18 to take over a tenancy. The judge rejected claims that this law was unconstitutional or breached human rights, ultimately upholding Clúid’s decision to terminate the tenancy.
